These Terms of Service ("Terms") govern your use of the website weshootlistings.com and the services provided by Black Beans Media LLC, doing business as We Shoot Listings ("Company," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.

1. Services

We Shoot Listings provides professional real estate media services including, but not limited to: photography, video walkthroughs, drone photography, Matterport 3D tours, floor plans, and virtual staging. Services are booked through our online ordering system at order.weshootlistings.com.

2. Booking and Payment

• All bookings must be made through our online platform. Payment is due at the time of booking unless otherwise agreed in writing.
• Prices are subject to change without notice. The price quoted at the time of booking will be honored.
• Rush delivery fees, travel fees (for properties outside our standard service area), and other add-ons are disclosed during the booking process.

3. Cancellations and Rescheduling

• Cancellations made 24 hours or more before the scheduled appointment will receive a full refund or credit.
• Cancellations made less than 24 hours before the scheduled appointment may be subject to a cancellation fee.
• We reserve the right to reschedule appointments due to severe weather or unforeseen circumstances.

4. Property Access

The client is responsible for ensuring that our team has proper access to the property at the scheduled time. If Supra lockbox access is required, the CBS (Call Before Showing) code must be provided at time of booking. We are not licensed real estate agents and rely on client-provided access.

5. Deliverables and Turnaround

• Standard turnaround is next-morning delivery for most orders placed before 5:00 PM.
• Rush delivery (same-day) is available for an additional fee.
• Final media is delivered via a digital download link. The client is responsible for downloading and saving all materials.

6. Intellectual Property and License

Upon full payment, the client is granted a non-exclusive, non-transferable license to use the delivered media for marketing the specific property photographed. This includes MLS listings, social media, and print materials related to that property.

• We retain the copyright to all photos and videos.
• We reserve the right to use the delivered media in our portfolio, website, and marketing materials unless otherwise agreed in writing.
• Resale, sublicensing, or transfer of media to third parties without our written consent is prohibited.

7. SMS Communications

By providing your phone number and opting in through our chat widget or booking process, you consent to receive SMS communications from Black Beans Media LLC related to your bookings, order updates, and optional marketing messages. You may opt out at any time by replying STOP. Message and data rates may apply.

8. Limitation of Liability

To the fullest extent permitted by law, Black Beans Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability shall not exceed the amount paid for the specific service in question.

9. Disclaimer of Warranties

Our services and website are provided "as is" without warranties of any kind. We do not guarantee that our website will be error-free or uninterrupted.

10. Indemnification

You agree to indemnify and hold harmless Black Beans Media LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of our services.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Harris County, Texas.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of our services constitutes acceptance of the updated Terms.
